1. Agreement
By accessing or using the WA Top Painters website (watoppainters.com.au) or engaging WA Top Painters for painting services, you agree to these Terms of Service. If you do not agree, please do not use our website or services.
2. Services
WA Top Painters provides professional residential and commercial painting services across Perth, Western Australia. The specific scope of services for each project is detailed in the written quote provided to the client. All work is subject to a separate written service agreement.
3. Quotes and Pricing
All quotes provided by WA Top Painters are:
- Valid for 30 days from the date of issue
- Fixed-price for the described scope
- Subject to revision if the scope changes materially after acceptance
- Free and without obligation
WA Top Painters will notify the client of any scope changes that affect pricing before proceeding with additional work.
4. Payment Terms
Standard payment terms require a 20% deposit upon acceptance of quote, with the balance due upon completion and client sign-off following the final walkthrough. Commercial projects may have staged payment schedules as specified in the project agreement.
Late payments may incur interest at 10% per annum. WA Top Painters reserves the right to suspend work on projects with outstanding payments.
5. Workmanship Guarantee
WA Top Painters provides a 10-year written workmanship guarantee on all painting services. This guarantee covers defects in workmanship including peeling, flaking, excessive brush marks and uneven coverage attributable to our application.
The guarantee does not cover:
- Damage caused by physical impact, vandalism or misuse
- Paint failure caused by moisture intrusion from structural defects not present at the time of painting
- Normal paint chalking and fading due to UV exposure (particularly for exterior paints)
- Paint failure on surfaces that were not properly disclosed to WA Top Painters at the time of quoting
6. Website Use
The WA Top Painters website is provided for informational purposes. All content on this website is the property of WA Top Painters and is protected by Australian copyright law. You may not reproduce, distribute or create derivative works without our written consent.
We make reasonable efforts to ensure website information is accurate and current, but make no warranty as to the accuracy of any information provided.
7. Limitation of Liability
To the extent permitted by Australian law, WA Top Painters' liability is limited to the cost of re-performing the relevant services. We are not liable for indirect, consequential or special damages arising from our services or website use.
8. Governing Law
These terms are governed by the laws of Western Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Western Australia.
